Across International Lines the Hague Convention Application:
In a nutshell, a Hague Convention application may be made when a child is taken or retained across an international border, away from his or her habitual residence, without the consent of a parent who has rights of custody, if the two countries are parties to the Convention. The child must be promptly returned to the habitual residence unless the return will create a grave risk of harm to the child.
Every County has a special unit within their District Attorney's Office called The Child Abduction Unit. If you believe your child is within the U.S, an order for a local Family Law Court must be submitted to the Child Abduction Unit in the county from where the child was taken. The Child Abduction Unit will assist in finding the minor and returning him to the child's home state.
